Terms & Conditions

TERMS & CONDITIONS

Last updated: 6 September 2026

1. DEFINITIONS, SCOPE & DOCUMENT PRIORITY

1.1 In these Terms:

“Streamline” means Streamline Commercial Kitchens Pty Ltd ABN 92 686 958 047, ACN 686 958 047.

“Client” means the person or entity acquiring Goods or Services from Streamline.

“Goods” means equipment, components and materials supplied by Streamline.

“Services” means fabrication, delivery, installation and any other work supplied by Streamline.

“Accepted Documents” means these Terms and the product page, final checkout total, accepted quotation or written order confirmation, together with the versions of Streamline’s Shipping Policy and Refunds & Returns Policy made reasonably available before the Client accepted the order.

1.2 These Terms govern online purchases of Goods and accepted quotations for Goods or Services. Streamline will supply only the Goods and Services stated in the Accepted Documents, and the Client must pay the amounts stated in them.

1.3 If the Accepted Documents conflict, the accepted quotation or written order confirmation prevails for the specific scope, specifications and price; the final checkout total prevails for the total price of an accepted online order; the Shipping Policy governs shipping matters; and the Refunds & Returns Policy governs returns, refunds, transit-damage and warranty-claim processes. These Terms otherwise apply. Nothing in any document excludes, restricts or modifies a right, guarantee, liability or remedy that cannot lawfully be excluded, restricted or modified.

1.4 Product- or supplier-specific conditions may determine eligibility for a discretionary change-of-mind return or coverage under a voluntary manufacturer or supplier warranty. They do not replace Streamline’s obligations as seller, make a statutory remedy dependent on supplier approval, or bind the Client unless disclosed and incorporated into the accepted order.

1.5 A later change to a website policy does not alter an existing accepted order without the parties’ agreement, unless the change is required by law and may lawfully apply.

2. STREAMLINE’S OBLIGATIONS

2.1 Depending on the Accepted Documents, Streamline will:

a. supply the specified Goods and perform fabrication, delivery, installation or other Services only where expressly included;

b. perform Services with reasonable care and skill and in accordance with applicable law;

c. complete fabrication in accordance with agreed specifications, drawings and disclosed manufacturer tolerances; and

d. comply with applicable workplace health and safety obligations while performing Services on site.

2.2 If unavailability requires a proposed substitution or other change that materially affects appearance, performance, price, timing or scope, Streamline will disclose the change and obtain the Client’s agreement before proceeding.

2.3 Minor disclosed or customary manufacturing tolerances are not defects where they do not cause the Goods or Services to depart from the Accepted Documents, an applicable description or sample, their stated purpose, acceptable quality or another statutory guarantee. This clause does not limit statutory rights.

3. CLIENT OBLIGATIONS & SITE REQUIREMENTS

3.1 The Client must:

a. cooperate reasonably with Streamline to facilitate the agreed supply, delivery and installation;

b. obtain required council, landlord, building, fire, health and other approvals unless the Accepted Documents expressly allocate that responsibility to Streamline;

c. provide accurate dimensions, plans, service locations, access information and specifications;

d. ensure the site is accessible, structurally suitable, weatherproof and ready for the agreed work;

e. provide safe access and any power, water, drainage, gas or other services expressly required for the work; and

f. take reasonable steps to prevent delays, failed delivery or re-attendance caused by the Client or its nominated contractors.

3.2 The Client is responsible only for reasonable additional costs actually incurred to the extent directly caused by materially inaccurate information, undisclosed access restrictions, site unreadiness, a missed delivery, or an act or omission of the Client or its nominated contractor.

3.3 Streamline will disclose the basis and amount of a calculable additional charge before incurring it where reasonably practicable. No charge applies to the extent the cost was caused by Streamline or a person for whom Streamline is responsible, or where the law does not permit the charge.

4. QUOTATIONS, ORDERS, PRICING & AVAILABILITY

4.1 A quotation, proposal or estimate remains subject to acceptance and any stated validity period.

4.2 An order submitted by the Client, including acceptance of a quotation, is an offer to acquire the stated Goods and Services. An automated order receipt, payment authorisation or acknowledgement is not acceptance by itself unless it expressly says so.

4.3 Streamline accepts an online order when it sends express written acceptance or dispatch confirmation. For a quotation-based order, Streamline accepts when it sends written acceptance or begins the agreed procurement, fabrication or Services, whichever occurs first.

4.4 Before acceptance, Streamline may decline an order where reasonably necessary, including verified unavailability, an unserviceable delivery address, a genuine pricing or specification error, or incomplete information. If payment has been taken for an order Streamline does not accept, Streamline will promptly refund the affected amount.

4.5 Streamline will take reasonable steps to keep product descriptions, prices and availability accurate. Goods advertised as available must be capable of purchase and delivery to the stated destination on the disclosed terms. Back-order, pre-order, supplier-direct and custom-quote status, together with any available expected date, will be disclosed where applicable.

4.6 Streamline will not substitute Goods, materially change the agreed scope or charge a different product or delivery price after acceptance without the Client’s agreement or another lawful contractual right.

4.7 The complete amount payable, including GST and every quantifiable unavoidable or pre-selected charge, will be shown or confirmed before Streamline accepts the order. If a custom or revised freight quote is required, Streamline will disclose the revised total and obtain the Client’s agreement before accepting the affected order or charging an additional amount. If Streamline cannot provide the agreed delivery for the total already accepted, the Client may cancel the affected Goods and receive a refund of the amount paid for them.

5. FABRICATION, SHIPPING, DELIVERY & INSTALLATION

5.1 Once fabrication or special procurement has commenced, the scope may be changed only by written agreement and may involve a reasonable price adjustment and revised timing disclosed before the variation proceeds.

5.2 Shipping charges, handling and transit estimates, pickup availability, delivery areas and access requirements are set out in Streamline’s Shipping Policy.

5.3 Processing, dispatch and delivery dates are estimates unless Streamline expressly agrees to a fixed date in writing. Streamline will notify the Client if it becomes aware of a material delay and provide an updated estimate. If paid Goods cannot be supplied within an agreed or reasonable time, Streamline will provide any solution required by applicable law.

5.4 Where Streamline arranges delivery, risk in the Goods passes when the Goods reach the agreed delivery point or when the carrier leaves them under an authorised unattended-delivery instruction. If the Client independently arranges collection or its own carrier, risk passes when Streamline hands the Goods to the Client or that carrier. Title remains with Streamline until full payment. Nothing in this clause limits a right or remedy protected by law.

5.5 The Client should inspect the Goods and packaging promptly and notify Streamline in writing as soon as reasonably practicable of damage, shortage, tampering or incorrect Goods, preferably within 48 hours where possible. Prompt notice and available evidence help preserve carrier and supplier claims. Missing the preferred timeframe, signing a delivery record, or not having photographs or original packaging does not constitute acceptance of faulty or non-conforming Goods and does not limit a right or remedy protected by law.

5.6 Installation is included only where stated in the Accepted Documents. The Client remains responsible for safe site access, unloading resources and trade connections allocated to it in those documents or the Shipping Policy.

6. FEES, GST, DEPOSITS & PAYMENT

6.1 All amounts are in Australian dollars. Website and online-checkout product prices, including shipping shown at checkout, include GST. A project or trade quotation may state an amount exclusive of GST only where this is clearly identified and the GST amount and total payable are disclosed before acceptance.

6.2 Any deposit and its cancellation treatment will be stated in the quotation before acceptance. A deposit is applied towards the contract price and may be retained only to the extent permitted by law for reasonable, disclosed loss, conforming work completed or non-recoverable commitments caused by a discretionary cancellation. Streamline will take reasonable steps to mitigate its loss and refund any balance. This clause does not limit a refund required by law.

6.3 Unless otherwise agreed in writing, full payment or agreed progress payments must be received at the stages stated in the Accepted Documents. Streamline may pause affected work or withhold delivery while an undisputed overdue amount remains unpaid, subject to applicable law.

6.4 Any additional amount for an agreed variation, Client-caused delay, re-attendance, storage or re-delivery must be reasonable, disclosed and, where practicable, agreed before it is incurred, and is payable only where legally recoverable. Streamline will not impose an undisclosed mandatory charge after online checkout.

7. VARIATIONS & CANCELLATION

7.1 A variation to scope, design, materials, price or installation conditions must be agreed in writing before the varied work proceeds.

7.2 An agreed variation may change pricing or timing. Streamline is not required to proceed until the variation is agreed.

7.3 If the Client requests a discretionary cancellation after acceptance, Streamline may charge only a lawful and reasonable amount for conforming work completed and non-recoverable commitments caused by the cancellation, after taking reasonable steps to mitigate loss. Streamline will refund any balance.

7.4 Nothing in this section limits a statutory right to cancel, reject Goods, terminate Services or receive a refund.

8. QUALITY, WARRANTIES & CONSUMER GUARANTEES

8.1 Goods and Services must comply with the Accepted Documents, applicable manufacturer specifications and all guarantees or obligations imposed by law.

8.2 Goods may include a voluntary manufacturer or supplier warranty. Its duration, coverage, exclusions and service arrangements vary by product and are those stated for the affected product or supplied with it. Streamline does not promise a broader voluntary warranty unless it does so expressly in writing.

8.3 A product-specific voluntary warranty may require registration, qualified installation, routine maintenance, specified operating conditions, prompt notice, proof of purchase, a serial number, return-to-base service or approval before a third-party repair. Those requirements apply only to the voluntary warranty concerned.

8.4 Voluntary warranty coverage may be affected where, and to the extent that, a failure is caused or contributed to by misuse, neglect, inadequate maintenance, non-compliant installation, abnormal conditions, unauthorised alteration or repair, or use contrary to instructions. These matters do not automatically exclude a claim for an unrelated failure or remove rights under the Australian Consumer Law.

8.5 Streamline will assess warranty and consumer-guarantee claims made to it. Streamline may coordinate with a manufacturer or supplier, but will not make a remedy it must provide by law dependent on supplier approval. Manufacturer and supplier warranties are additional to, and do not replace, Streamline’s obligations as seller or any non-excludable statutory guarantee.

9. RETURNS, REFUNDS & CLAIMS

9.1 Returns, refunds, transit-damage claims, faulty-Goods remedies and voluntary warranty claims are governed by Streamline’s Refunds & Returns Policy, which forms part of these Terms.

9.2 Product- and supplier-specific conditions may determine eligibility or charges only for a discretionary change-of-mind return or voluntary supplier-warranty process. They do not limit a right, guarantee or remedy that cannot lawfully be excluded.

9.3 If these Terms conflict with the Refunds & Returns Policy on a return, refund or claim matter, that Policy applies, subject always to Australian law.

10. LIABILITY & CLIENT RESPONSIBILITY

10.1 Nothing in these Terms excludes, restricts or modifies any right, guarantee, liability or remedy under the Australian Consumer Law or another law that cannot lawfully be excluded, restricted or modified.

10.2 To the extent permitted by law, Streamline is not liable for loss to the extent it was not caused by Streamline’s breach or negligence or was not reasonably foreseeable. This clause does not exclude compensation for reasonably foreseeable loss or damage recoverable under the Australian Consumer Law.

10.3 The Client is responsible for a third-party claim or loss only to the extent directly caused by the Client’s negligent, unlawful or wilful act or omission, breach of these Terms, misuse of Goods, or act of its nominated contractor. This responsibility does not apply to the extent Streamline or a person for whom Streamline is responsible caused or contributed to the claim or loss.

11. EVENTS BEYOND REASONABLE CONTROL

11.1 An event beyond reasonable control is an event that prevents or materially delays performance despite reasonable precautions. An unexpected supplier or carrier delay qualifies only to the extent it was beyond the affected party’s reasonable control and could not reasonably have been avoided or overcome.

11.2 The affected party must notify the other within a reasonable time, explain the expected effect and take reasonable steps to reduce it. Obligations are suspended only to the extent and for the period genuinely prevented. This section does not excuse a defect, require payment for Goods or Services not supplied, or limit a non-excludable right or remedy.

11.3 If the delay becomes substantial or performance becomes impracticable, either party may terminate the affected portion. Streamline will refund amounts paid for undelivered Goods or unperformed Services, less only an amount lawfully payable for conforming work already supplied or an expressly approved non-recoverable custom commitment, unless applicable law requires a full refund.

12. INTELLECTUAL PROPERTY

12.1 Intellectual property rights in designs, drawings, plans, specifications, photographs, documents, concepts, trademarks, branding and website content are owned by or licensed to Streamline unless expressly stated otherwise.

12.2 The Client must not copy, reproduce, distribute, modify, publish or use that intellectual property without Streamline’s prior written consent, except as permitted by law or as reasonably necessary for the intended use of the Goods or Services.

12.3 Nothing in these Terms transfers ownership of intellectual property to the Client.

13. PRIVACY

13.1 Streamline handles personal information in accordance with its Privacy Policy and applicable privacy law.

13.2 Streamline will use information supplied for order fulfilment, delivery, support, legal compliance and other purposes described in the Privacy Policy.

14. RELATIONSHIP & SITE COORDINATION

14.1 Streamline is an independent contractor. Nothing in these Terms creates employment, partnership, joint venture or agency between the parties.

14.2 The Client remains responsible for overall site coordination, service readiness and compliance except to the extent the Accepted Documents allocate a responsibility to Streamline.

15. ACCEPTANCE OF TERMS

15.1 These Terms bind the Client only if provided or made reasonably available before the Client accepts the order. The Client may accept through written acceptance, an informed checkout acceptance, payment after notice of the Terms, or an instruction to begin procurement, fabrication or Services. Streamline accepts the order as stated in section 4.

15.2 After acceptance, a discretionary cancellation or variation is governed by the Accepted Documents. This does not limit a statutory right to cancel, reject Goods, terminate Services or receive a refund.

15.3 Taking delivery, signing a delivery record or beginning reasonable inspection or use does not constitute acceptance that the Goods conform and does not waive a defect, damage, shortage, misdescription or statutory claim.

16. GOVERNING LAW

16.1 These Terms are governed by the laws of Queensland, Australia. The parties submit to the non-exclusive jurisdiction of Queensland courts, without limiting a right to use another court, tribunal or process available under applicable law.
